I wonder if this judge would rule the same way, if it was his wife or daughter or himself had been raped? (This kind of ruling could come back to haunt him some day! We are suppose to have justice for all!)
What is happening to our Justice System?

So how do you do anything in a court when you can't name the alledged crime, refer to the victim or the accused?
How can you talk about a crime that was committed if you can't name the evidence that proves a crime was committed. I'm telling you, this PC BS is ruining the entire Western legal system.

I keep thinking that we are evolving, moving forward, using our minds to better the world, but the PC people who have no experience at anyting, just drivel they have read in a book somewhere, now rule the world and loose touch with reality because of "technicalities".
Women are being thrown back into the stone age, they are now "nappy headed Ho's and Bit#es. And the ones who are raped and stoned in the streets in other parts of the world, are the rights of "other" so called "people".
Human is far too kind a word to describe anyone who would do such a thing.

Though I'm also shocked at the implications of barring such descriptive words, I have to say that I can understand the thoughts of the judge...at least partially.
In the case of the Duke lacrosse team and their stripper, there wasn't any evidence that a crime had been committed. That seems to cause the words "rape" and "victim" to be prejudicial, and possibly "assailant," if they're referring to the defendant. (Though I don't know why the judge couldn't order the victims and lawyers to use "alleged rape," "alleged victim," etc.
"Sexual-assault kit" or "rape kit" seem to me to be the terminology used to describe this evidence-collecting tool, so I think those should be permitted.

I have mixed feelings because I too understand the reasoning from all sides. I think if people could be assured that the judge's intentions are pure and it's not an abuse of power to satisfy his own agenda, perhaps some would be able to see the broader implications. Unfortunately, there have been a few cases in recent history where the judge showed inexplicable bias towards the accuser, even before any testimony began.
May justice, whatever that is, be served in the next trial.

I don't believe in the death penalty, but sometimes women and children are raped to the point of near death. Do you realize or understand what a brutal rape does to a woman or child's body? Many do in fact die. A brutal rape should be treated the same as a near murder.

Women in Iraq have virtualy no rights in a rape case, it takes 4 male witnesses to testify that a rape even occured in many areas. On top of that, parents of a rape victim can kill thier daughter as an honor killing after that because the daughter has brought shame on the family for being raped.
Now who is the barbarian?

You know, that's not entirely a fair comparison. The only people who believe this are "fundamentalist" or "reactionary" muslims. Most muslims, esp. women, are moderates that believe in rape kits, DNA evidence and modern science. If you say all Muslims believe in Sharia or fundamentalist law, that's the same thing as saying all Christians believe abortion doctors should be sniped and abortion clinics bombed. There is no comparison. Many Muslims are fighting for modern rights and you are saying they all live in the dark ages. Not fair. Muslim women don't agree with what you are saying at all. They believe in democracy and fair trials. They love their religion and they believe in a moderate or even liberal interpretation, and you shove them into the background and do them a great disservice. How dare you speak so unkindly of them?

I am right there with you, our legal and justice system has gone completely to h*ll.
It is all about the money now. Poor criminals arent even charged because the cops know they cant get any money from them. Rich criminals just pay a lot of money and get let go.
In Virginia, they have decided to give $3000 fines for speeding to make money, they arent even trying to hide the fact that they just want to stick it to the residence to take their money.

We've had conversations about this in my journalism classes during the kobe bryant rape trial and the whole duke fiasco. While no one ever talked about banning the word rape because in trial they often just say non consensual sex.
But using the word "victim" is something that we've been talking about because when the word is used it assumes that the crime has happened and casts the light sometimes in favor of that victim. I guess in hindsight in the duke case we'd all agree not to let her be called a "victim" but during the whole process and looked what happened, those boys will live with that stigma their whole life.
I'm not saying ban the word, I'm not sticking up for rape criminals but I'm saying perhaps we should reconsider how it's used and in what context and the effects that come from it.

Of course we all know if your wearimg a short skirt you had it coming. Feminism has a long way to go. All its done now is made women able to get a dead end job outside the home. Stand up for yourselfs call rape what it is.
