Can they still say a crime was committed? Or is that to prejudicial too?

Take a friggin' pill. Go off topic much?

get a clue? YOU might want to take your own advice, I'm a guy, and a very conservative one at that. I just happen to think it's insane to ban the words rape and victim in a rape trial.

Don't worry Zaph Atlas is no woman.

I wasn't worried, it was just that this...

"you asked for it well now you got it.

GOD DAMN i am so sick of hearing you TOSSERS cry like little BI-ITCHES.

get a clue."

gave me the impression that Atlas is under the very wrong impression I posted this because I'm a woman, Atlas is the one without a clue. I posted it because it seemed rather insane to me to have a trial for a crime and not allow that crime to be mentioned during the trial, or that anyone was a victim of that crime. And then Atlas decided to add to the insanity of it all.

Does anyone see the irony in shrugg's rapacious attitude and this story?

Thank you for posting it Zaph.

I wonder if this judge would rule the same way, if it was his wife or daughter or himself had been raped? (This kind of ruling could come back to haunt him some day! We are suppose to have justice for all!)

What is happening to our Justice System?

Thanks zaph, just more proof of errosion of our rule of law in our country!

A mistrial was declared in this case because of demonstrations.

So how do you do anything in a court when you can't name the alledged crime, refer to the victim or the accused?

How can you talk about a crime that was committed if you can't name the evidence that proves a crime was committed. I'm telling you, this PC BS is ruining the entire Western legal system.

avatar

I keep thinking that we are evolving, moving forward, using our minds to better the world, but the PC people who have no experience at anyting, just drivel they have read in a book somewhere, now rule the world and loose touch with reality because of "technicalities".

Women are being thrown back into the stone age, they are now "nappy headed Ho's and Bit#es. And the ones who are raped and stoned in the streets in other parts of the world, are the rights of "other" so called "people".

Human is far too kind a word to describe anyone who would do such a thing.

Though I'm also shocked at the implications of barring such descriptive words, I have to say that I can understand the thoughts of the judge...at least partially.

In the case of the Duke lacrosse team and their stripper, there wasn't any evidence that a crime had been committed. That seems to cause the words "rape" and "victim" to be prejudicial, and possibly "assailant," if they're referring to the defendant. (Though I don't know why the judge couldn't order the victims and lawyers to use "alleged rape," "alleged victim," etc.

"Sexual-assault kit" or "rape kit" seem to me to be the terminology used to describe this evidence-collecting tool, so I think those should be permitted.

I have mixed feelings because I too understand the reasoning from all sides. I think if people could be assured that the judge's intentions are pure and it's not an abuse of power to satisfy his own agenda, perhaps some would be able to see the broader implications. Unfortunately, there have been a few cases in recent history where the judge showed inexplicable bias towards the accuser, even before any testimony began.

May justice, whatever that is, be served in the next trial.

The judge who ordered this is a complete freaking moron!

There is a special school judges go to to prepare themselves. After they learn how to use their heads for suppositories, decisions are made in that rarefied atmosphere.

No wonder the criminals in uniform called US Troops in Iraq are having fun raping Iraqi children and women, cause they will not be charged with anything.

What has the world come to.

In my native country, a rape is a rape and the perpetrator is executed.

avatar

Executed for rape? Humarabi wouldnt even agree with that.

How exactly do you put a hate comment about US Troops in this article? Are you that desperate to show your dislike for America?

avatar

I gave him a point just for using the word 3 times...

More than anyone else here, and more than the trial...

I don't believe in the death penalty, but sometimes women and children are raped to the point of near death. Do you realize or understand what a brutal rape does to a woman or child's body? Many do in fact die. A brutal rape should be treated the same as a near murder.

I'm sure a lot of laws have changed, but in the sixties, rape was executable in most states in the U.S., as I recall.

avatar

And I believe it should be brought back, especially when children are the victims. When a society won't protect its young or women then it is lost

If you were serving our nation in Iraq, does that mean you would be raping women anbd children in Iraq? You sadly betray your mentality with this statement.

Women in Iraq have virtualy no rights in a rape case, it takes 4 male witnesses to testify that a rape even occured in many areas. On top of that, parents of a rape victim can kill thier daughter as an honor killing after that because the daughter has brought shame on the family for being raped.

Now who is the barbarian?

avatar
Reply

You know, that's not entirely a fair comparison. The only people who believe this are "fundamentalist" or "reactionary" muslims. Most muslims, esp. women, are moderates that believe in rape kits, DNA evidence and modern science. If you say all Muslims believe in Sharia or fundamentalist law, that's the same thing as saying all Christians believe abortion doctors should be sniped and abortion clinics bombed. There is no comparison. Many Muslims are fighting for modern rights and you are saying they all live in the dark ages. Not fair. Muslim women don't agree with what you are saying at all. They believe in democracy and fair trials. They love their religion and they believe in a moderate or even liberal interpretation, and you shove them into the background and do them a great disservice. How dare you speak so unkindly of them?

avatar
Reply

Wow, I have no idea where your opinion that I feel so ill toward women in the Muslim faith, but it is those who are victims of the extremists that I speak in protest.

If they believe in fair trials, then where is the balance of power in the court for victims of rape? Even if the other women on Islam feel that a woman stoned to death for being raped, is just, I am afraid that they are every single one wrong. And it is because of a murderous hateful religion.

When a woman can walk the street on her own, with her head held high, showing the face that mother nature gave her with pride, and be able to voice her mind in any context, be it religion, politics, financial management, or sex, then the world will be a better place.

As long as women are seen as lesser humans, the rest of the world will know barbarians are in control.

Wait til I get a jury summons. They'll disqualify me when I tell them I no longer believe in the justice system. Isn't there a piece in the constitution about the people disbanding the . . . Uh-oh. That sounds like rebellion, treason, . . .

avatar
Reply

I am right there with you, our legal and justice system has gone completely to h*ll.

It is all about the money now. Poor criminals arent even charged because the cops know they cant get any money from them. Rich criminals just pay a lot of money and get let go.

In Virginia, they have decided to give $3000 fines for speeding to make money, they arent even trying to hide the fact that they just want to stick it to the residence to take their money.

We've had conversations about this in my journalism classes during the kobe bryant rape trial and the whole duke fiasco. While no one ever talked about banning the word rape because in trial they often just say non consensual sex.

But using the word "victim" is something that we've been talking about because when the word is used it assumes that the crime has happened and casts the light sometimes in favor of that victim. I guess in hindsight in the duke case we'd all agree not to let her be called a "victim" but during the whole process and looked what happened, those boys will live with that stigma their whole life.

I'm not saying ban the word, I'm not sticking up for rape criminals but I'm saying perhaps we should reconsider how it's used and in what context and the effects that come from it.
